Can You Travel with Cannabis in Spain? Train, Plane & Car

It’s one of the most common questions we hear from members and visitors alike: “I’m taking the AVE to Madrid — can I bring some with me?”, “I’m flying home, is a couple of grams really a problem?”, “what about my own car?”. The short answer is that no means of transport is a safe or legal place to carry cannabis in Spain. In this article we explain exactly why, what the law says in each case, and what the sensible alternative is if you live in Seville or you’re visiting.

The golden rule: private yes, public no

Spanish law follows one consistent logic: consumption and possession in private are not criminalised, but possession in public spaces is a serious administrative offence under the Citizen Security Law, with fines starting at €601 and climbing steeply from there.

And what counts as public? Practically everything you cross when you travel: the street, Santa Justa station, San Pablo airport, the inside of your car on a public road, the AVE carriage. Travelling is, by definition, moving through public spaces — which is why transporting cannabis is always sanctionable territory, even in tiny amounts and even if it’s strictly for your own use.

Can I carry cannabis in my car?

This is where most confusion lives, because a car feels private. Legally, it isn’t while driving on a public road. There are three separate fronts to keep in mind:

What about the AVE or trains?

Renfe stations use luggage scanners and security staff, especially at major hubs like Santa Justa or Atocha. Both the station and the train itself are public spaces: possession is sanctionable exactly as it would be in the street, and detection dogs aren’t unusual at busy stations. Taking the AVE with cannabis is simply betting nobody looks — with a three-figure fine as your consolation prize if you lose.

And flying?

The worst-case scenario of all. Airport security screens all luggage, with Guardia Civil presence, and the consequences escalate fast:

• Domestic flight: public possession means an administrative fine, with maximum exposure at the security checkpoint.
• International flight: crossing a border with cannabis can qualify as smuggling or trafficking — criminal offences carrying prison sentences. And when you land, the destination country’s law applies too, which may be far harsher than Spain’s.

No nuance here: never fly with cannabis, in any amount, under any circumstances.
